قال خبير قانون دولي إن من أصدروا مذكرة توقيف بحق الرئيس الروسي فلاديمير بوتين قد لا يترددون في إصدار أمر اعتقال بحق شخص مثل رئيس الوزراء الإسرائيلي بنيامين نتنياهو.
وفي تقرير لصحيفة هآرتس Haaretz الإسرائيلية عن الموضوع قال الكاتب بها سام سوكول إن قرار المحكمة الجنائية الدولية الأخير مؤشر على استعدادها لاتخاذ إجراءات ضد قادة دول قوية غير أعضاء بها بطريقة لم تجرؤ عليها من قبل، مما يزيد من احتمالية السعي إلى توجيه الاتهام إلى القادة الإسرائيليين في المستقبل.
ونسبت الصحيفة لخبير في القانون الدولي في كلية بوخمان للقانون بجامعة تل أبيب هو إلياف ليبليش قوله إن مذكرة توقيف بوتين “تزيد من المخاطر على القيادة الإسرائيلية”.
واستطرد الخبير يقول: “لقد أظهروا الإرادة السياسية لمواجهة رئيس إحدى أقوى الدول في العالم والتي يمكن أن ترد بطرق غير معهودة، بما في ذلك العنف”، وتزامن ذلك التعليق -تقريبا- مع تهديد نائب الرئيس الروسي السابق ديمتري ميدفيديف المبطن بضرب المحكمة بصاروخ تفوق سرعته سرعة الصوت.
وإذا كانت المحكمة قد تجرأت على إصدار مثل هذا الأمر بحق بوتين، فإن ليبليش يرى أنهم إذن “لن يترددوا في إصدار أمر اعتقال ضد شخص مثل نتنياهو”، مضيفا أنه “على المستوى القانوني، أوضحت المحكمة أنها “لا تعتقد أن رؤساء الدول، التي ليست عضوا في المحكمة، يتمتعون بحصانة شخصية أمام المحكمة الجنائية الدولية”.
ولفت في هذا الإطار إلى أن إسرائيل، رغم أنها ليست عضوا في المحكمة وتقول إنه ليس للجنائية الدولية سلطة التحقيق في الجرائم المرتكبة داخل هذا البلد، فقد قضت هذه المحكمة في عام 2019 بأن لها اختصاصا في الأراضي الفلسطينية، وفي عام 2021 وافقت على طلب فتح إجراءات قانونية ضد إسرائيل وحماس للاشتباه في ارتكابهم جرائم حرب.
ولفت الكاتب إلى أن هذه المحكمة مشغولة حاليا مع قضية روسيا، موضحا أن إسرائيل ربما لم تختطف أطفالا بشكل منهجي، إلا أن بعض أفعالها يمكن مقارنتها بتلك التي تقوم بها روسيا، بما في ذلك نقل بعض سكانها إلى الضفة الغربية المحتلة، كما يقول ليبليش، مضيفا أن بعض المبادرات التشريعية التي تروج لها الحكومة الإسرائيلية الحالية يمكن أن تجذب انتباه الجنائية الدولية.
ويرى ليبليش أن أحد عوامل الخطر الرئيسية في الوقت الحالي يظل دفع الحكومة الإسرائيلية من أجل تقويض استقلال القضاء الإسرائيلي، وهي خطوة يقول ليبليش إنها “تعزز فرص تدخل المحكمة الجنائية الدولية”.
