أعرب achrights مركز وصول لحقوق الإنسان (ACHR) اليوم 12 أيلول (سبتمبر) 2024 عن قلقه البالغ ومعارضته الشديدة للمداولات الأخيرة التي أجراها مجلس الوزراء اللبناني بشأن ما يسمى خطة “العودة الطوعية” للاجئين السوريين.
وينص الاقتراح، الذي أعلن عنه في 14 آب (أغسطس)، على أن تقدم الوزارات والهيئات الإدارية مقترحاتها للخطة خلال أسبوع واحد قبل التنسيق مع الدولة السورية لتفعيل خطة الإعادة القسرية. تمثل الخطة استمرارًا للتدابير القسرية غير القانونية، وهي جزء من حملة ضغط طويلة الأمد تهدف إلى إعادة اللاجئين السوريين قسرًا إلى سوريا في انتهاك لالتزامات لبنان بعدم الإعادة القسرية.
وتمثل الخطة الأخيرة أحدث محاولة من جانب السلطات اللبنانية لتبني سياسات تهدف إلى الإعادة القسرية للاجئين
السوريين إلى سوريا. وتوضح القائمة أدناه المحاولات الرسمية السابقة لتبني سياسات مماثلة:
بعام 2015 ، نجحت السلطات اللبنانية في الضغط على المفوضية السامية للأمم المتحدة لشؤون اللاجئين لوقف تسجيل اللاجئين الجدد، مما ترك مئات الآلاف من اللاجئين في مأزق قانوني، غير قادرين على الوصول إلى حقوقهم الأساسية. وقد فشلت هذه السياسة في منع اللاجئين من دخول لبنان عبر طرق غير نظامية.
محاولات بوساطة حزب الله لتنظيم ما يسمى “عودة طوعية” إلى المناطق الخاضعة لسيطرته في سوريا. وهذه هي المناطق التي سبق أن قام حزب الله بتهجير سكانها من خلال العمليات العسكرية.
المبادرة الروسية لتشجيع اللاجئين على العودة إلى ما يسمى “مناطق خفض التصعيد” في سوريا. ولايزال هذا غير ناجح إلى حد كبير بسبب استمرار الظروف غير الآمنة في سوريا.
بعام 2019 قرار المجلس الأعلى للدفاع اللبناني بترحيل اللاجئين الذين دخلوا لبنان “بشكل غير قانوني” بعد نيسان ،2019 وبدأ الجيش اللبناني بتنفيذها بشكل رسمي في نيسان 2023 مما أدى إلى تفاقم شعورهم بعدم الأمان وأدى إلى انتهاكات جسيمة لحقوق الإنسان.
بعام 2022/ 2023 : حملات ترحيل قسرية أدت إلى انتهاكات جسيمة لحقوق الإنسان في كل من لبنان وسوريا. ولا تزال الغالبية العظمى من اللاجئين السوريين ترفض العودة إلى وطنهم بسبب المخاطر التي تنتظرهم عند عودتهم.
السياسة اللبنانية – تؤدي إلى مزيد من الانفلات الأمني وانتهاكات حقوق الإنسان:
كما هو موضح أعلاه، فإن موقف الحكومة اللبنانية الطويل الأمد المتمثل في تبني مبادرات تهدف إلى إعادة اللاجئين السوريين بشكل جماعي إلى سوريا قد فشل عمومًا في تحقيق أهدافه المقصودة. وبدلًا من ذلك، خلقت كل من هذه المبادرات المزيد من انعدام الأمن للسوريين في لبنان، وقد اتسمت عمليات الترحيل المستمرة بانتهاكات جسيمة لحقوق الإنسان، بما في ذلك سوء المعاملة والتمييز والاختفاء القسري، وحتى التعذيب. من خلال الاستمرار في اتباع هذه السياسات غير القانونية من خلال هذه الإجراءات، لا يتجاهل لبنان المخاطر الوشيكة التي يواجهها المبعدون عند عودتهم إلى سوريا فحسب، بل يساهم أيضًا بشكل منهجي في هذه الانتهاكات أثناء عمليات الترحيل هذه.
